Getting to a Paperless Office - Legal Productivity
We all aspire to a more paperless office ? it helps the environment and increases efficiency and productivity. But it requires consistent effort. Here are a few tips to get you started:
Paper-less not paper-free
The world is not ready for paper-free. Sure you can buy a movie ticket online but you often have to print a copy to enter the theater. Same with many plane tickets, and classroom and continuing legal education (CLE) materials, and court documents. Acknowledging this and accepting that there are limitations will go a long way to warding off frustration and procrastination.
Note-taking during conference calls, meetings and CLEs
Get rid of your message pad and notebook and fire up Evernote to take notes during meetings, calls and CLE classes and training sessions. You?ll solve the problem of trying to recognize your handwritten scrawl later and you can easily share the note by emailing it to colleagues. Tasks and to-do lists assigned during the meeting? No problem. Quickly create checklists in Evernote. Notes are saved as you type and are fully search-able. I have a Notebook called ?Meetings and Calls? and open a new note before each Skype call or GoToMeeting rendezvous.
Scan and backup
Scan meeting handouts and other documents into Evernote or Google Docs or store them on your computer.
Don?t make an extra copy of that brief, CLE materials or receipt, then put it in a manilla folder, label it and store it in a filing cabinet. Instead, download the freemium Dropbox and sync select files to the cloud. If you scanned the documents into Evernote or Google Docs, they?re already backed up online, but with Dropbox, you also have a copy on your local drive. You can also upload the documents to a cloud-based practice management software.
Then get rid of the filing cabinet and clear up some office space.
Create paperless habits
A paperless office doesn?t happen overnight. It takes effort and commitment. Over time it becomes much easier if you create habit forming work-flows. Like when you sit down to open your mail. In addition to having a shredder nearby, have your scanner ready to go for those documents that you wish to save. Same with receipts for expense reports ? as you get them, snap a picture and store it on your local drive, Evernote or online. Nothing is as discouraging as watching a pile of to-scan documents grow out of control on your desk.
As mentioned earlier, we?re attempting to minimize, not entirely get rid of paper. Though you may read most books on a tablet, laptop or smartphone, an occasional hard-copy purchase can be a delight. And I?ve yet to give up my moleskin entirely. But get the (mostly free) tools, acquire paperless habits and see those piles of paper disappear, resulting in a more productive and efficient office.

NEW YORK (AP) ? British teen Laura Robson faces a former Grand Slam champion in her next match at the U.S. Open, which shouldn't feel the least bit intimidating.
Not after she beat four-time major winner Kim Clijsters and 2011 French Open champ Li Na in three days. Next up is Sam Stosur, the defending champion at Flushing Meadows.
"She's obviously full of confidence and had two very, very good wins," Stosur said.
The 18-year-old Robson knocked out Li 6-4, 6-7 (5), 6-2 on Friday. Ranked 89th, Robson had never been past the second round of a major tournament or defeated a top-10 opponent before this year's U.S. Open. Now she's done both after eliminating the ninth-seeded Li.
Robson put her hands to her head in shocked joy after the Chinese star returned her serve long on the final point.
She showed poise after failing to close out the match in the second-set tiebreaker, then overcoming two incorrect calls in the third set where she had to replay points she would've won if the initial ruling had been right.
With a break point on Li's serve at 2-2 in the final set, Robson's return clipped the baseline and Li hit the ball wide. But the line judge called Robson's shot out and, after a review overturned it, Robson lost the replayed point. Li won the next point as well to earn game point. But with the Louis Armstrong Stadium crowd roaring its support, Robson rallied back to get the break.
On Wednesday, Robson ended Clijsters' career, winning both sets in tiebreakers in the second round against the 23rd-seeded Belgian. Robson's career may now be really getting started.
She became the next great British hope when she captured the 2008 Wimbledon girls title at age 14. Four years later, she seems to be reaching that potential, the youngest woman ranked in the top 100.
Robson is the first British woman to make the fourth round at a Grand Slam event since Sam Smith at 1998 Wimbledon.
Stosur was pushed for the first time in this year's Open by American Varvara Lepchenko, but dominated the second set after winning the first in a tiebreaker. The seventh-seeded Stosur, who won 7-6 (5), 6-2, had dropped just five games through her first two matches.
It was still a successful Open for the 31st-seeded Lepchenko. After reaching at least the third round in three straight Grand Slam events, she'll likely climb into the top 30 in the rankings.
Friday night could be the farewell for 2003 champion Andy Roddick. A day earlier, he announced this would be the final tournament of his career.
The American is set to face Bernard Tomic in Arthur Ashe Stadium.
In earlier men's action, fourth-seeded David Ferrer won the first two sets in 62 minutes, then needed 65 minutes to clinch the third set in a tiebreaker that went 26 points. The Spaniard beat Igor Sijsling 6-2, 6-3, 7-6 (12) in the second round.
NCAA champ Steve Johnson, who had played in just one Grand Slam match before this year's Open, reached the third round with a four-set win over 145th-ranked Ernests Gulbis.
The 22-year-old Johnson, ranked 245th, went undefeated this season for Southern Cal to win his second straight NCAA title and earn a wild card into the Open.

SOUTH AFRICA: S. African miners charged with murder of colleagues
AFP - Arrested Lonmin mine workers were on Thursday charged with the murder of 34 striking colleagues who were shot dead by South African police on August 16 during a strike over wages.
"The court today charged all the workers with murder, under the common purpose law," spokesman for the prosecutor's office Frank Lesenyego said.
Police opened fire on striking workers at the Marikana mine after a stand-off had already led to the death of 10 people including two police officers.
Following the shootings, 270 workers were arrested.
All the men were in custody and the state postponed the case until Thursday of next week to allow for further investigations.
Lesenyego said details of the murder charges would be revealed during the bail hearing.
One expert, however, questioned the charges.
"In charging the miners for the death of miners killed by the police, I don't see how common purpose doctrine could be used here," said Vincent Nmehille, a law professor at the University of the Witwatersrand.
Police have defended the shootings at the mine outside Rustenburg, northwest of Johannesburg, as self-defence.
The incident was the worst day of police violence in South Africa since the end of white-minority apartheid rule in 1994.

Paul Ryan is giving voters a vivid image of the nation's unemployment crisis.
If everyone now out of work stood in single file, he says, "that unemployment line would stretch the length of the entire American continent."
"You would think that any president, whatever his party, would make job creation, and nothing else, his first order of economic business," Ryan told GOP delegates. "But this president didn't do that. Instead, we got a long, divisive, all-or-nothing attempt to put the federal government in charge of health care."
Ryan's acceptance speech Wednesday night stands as one of the fiercest attacks on President Barak Obama's record in a convention flush with harsh words.
Leading such attacks is a traditional role for the No. 2 candidate on a ticket.

Leonardo Da Vinci's "Horse and Rider" sculpture (Jolson PR)A 504-year-old sculpture created by Leonardo Da Vinci was unveiled to the world in a special ceremony in Los Angeles this week. The "Horse and Rider" sculpture is the only known three-dimensional piece of art created by Leonardo that is known to still exist and is one of only about two-dozen authenticated works made by the Renaissance master in the world today.
"It's a momentous occasion, Art Encounter's Rod Maly told Yahoo! News before the statue's unveiling at the historic Greystone Mansion in Beverly Hills. "It's been in private collections for nearly 500 years, so it has not been promoted. Nothing like this has ever happened in the history of mankind."
And in a development that is sure to intrigue both historians and art fans alike, the sculpture is believed to contain a thumbprint of Leonardo himself.
For the past 500 years, the sculpture has only existed in beeswax form, along with the original mold itself. Experts spent the last three years crafting the first metal "master" sculpture, using the original mold, hand-crafted by Leonardo.
The small sculpture mold measures 12'' high, 12'' long and 7'' high and is believed to have been intended to serve as the model for a much larger sculpture. "Horse and Rider," features a Renaissance military figure riding upon a horse was created in 1508 by Leonardo as a gift for his friend and benefactor, French military governor Charles d'Amboise. After Leonardo's death in 1519, the sculpture was given to his apprentice Francesco Mezi and is believed to have remained with his family in Italy until the 1930's when it was moved to Switzerland for safe-keeping.

In 1985, American businessman Richard A. Lewis purchased the mold. "In all honesty, I was very na?ve to what I had," Lewis told Yahoo! News during an interview before the statue's unveiling. That same year, Lewis was contacted Dr. Carlo Pedretti, widely considered to the world's foremost living authority on Leonardo and Professor Emeritus of Art History and the Chair of Leonardo Studies at UCLA. Dr. Pedretti studied and eventually authenticated the mold.
"For someone to call up and say 'I think I own a Leonardo Da Vinci mold,' you're like yeah right, I'd like to put it next to my Mona Lisa," Brett Barney, president of the American Fine Arts Foundry told Yahoo! News. "But when he brought it in, right away we knew we had something."
Using what is called a "lost wax casting process," Barney and his team at the Foundry spent three years working with the mold and eventually created a bronze casting from it. In essence, they have created a new piece of sculpture from one of the world's true artistic masters, nearly 500 years after his death.
"It's the opportunity of a lifetime," Barney said. "To be part of a masterpiece by Da Vinci himself, I can't think of anybody that would be more prestigious."
When the mold was studied in detail, it was discovered that along the horse's right breast a thumbprint exists. And while there is currently no way to verify, the print is believed to belong to Leonardo himself.
The mold casting actually sat in Lewis' closet for more than 25 years before he contacted the Foundry. And now, Lewis is determined to share the discovery with the world. And along with the piece's historic value, Lewis is using the unveiling for a good cause. Several hundred metal castings have been made from the mold, which Art Encounter will be auctioning off. Lewis himself has committed to donating $1 million of the proceeds to the Salvation Army's substance abuse program.
"It is a magnificent piece of art and I'd like to have as many people as possible be able to appreciate it," Lewis told Yahoo! He said he eventually plans to donate the original mold and master sculpture to a museum.
After it's unveiling in Los Angeles, the mold and master sculpture will be displayed at various locations in New York, London and Las Vegas, home to a new Leonardo exhibit at the Venetian Hotel.

Venezuela firefighters struggle with refinery blaze
PARAGUANA, Venezuela (Reuters) - Venezuelan firefighters struggled to finish putting out a blaze at the country's biggest refinery on Tuesday, with a fuel tank twice bursting into flames within minutes of authorities declaring it fully extinguished.
The partly-melted storage tank burned on and off at the 645,000-barrel-per-day Amuay refinery as teams poured foam over it to suffocate a fire sparked by a pre-dawn blast on Saturday that killed 48 people.
The blaze had been put out at around 10:30 a.m. (1500 GMT). Though it was not immediately clear if it might break out again, the fire seemed to be largely under control.
Energy Minister Rafael Ramirez has said the facility should restart within two days of the fire being put out. None of the processing units were hit by the blaze, though refinery operations were shut down on Saturday for safety reasons.
Ramirez has repeatedly assured that Venezuela has sufficient fuel inventories to supply the domestic market and continue meeting export commitments.
U.S. gasoline futures dropped sharply on Tuesday, a day after rising as much as 3 percent on the combination of the Amuay fire and Tropical Storm Isaac's potential threat to U.S. to Gulf Coast refinery operations.
The blast flattened hundreds of homes and left dozens wounded. Many of the dead were National Guard troops who were providing security in a compound next to the tanks.
The charred remains of two other fuel tanks, which had been extinguished before dawn, were almost entirely melted from three days of the blazing inferno.
Traders say the impact on fuel markets may continue even after Amuay is up and running again. Tank farm accidents often cause problems with gasoline blending, which may leave PDVSA relying on imports.
Venezuela has for years had to import fuel due to recurrent refineries outages.
Chavez said at the scene on Monday that he was creating a fund worth about $23 million to help pay for clean-up operations and replace homes destroyed by the pre-dawn blast.
It was one of the most deadly oil industry accidents in recent years, nearing the toll of the 1997 fire at India's Visakhapatnam refinery that killed 56 and topping the 2005 blast at BP Plc's Texas City refinery in which 15 people died.

Private Neil Armstrong Memorial Service Set for Friday
Neil Armstrong, the first person to set foot on the moon, will be memorialized during a private ceremony Friday (Aug. 31) in Cincinnati, according to media reports.
Armstrong died Saturday at the age of 82, of complications from a recent heart surgery. The late astronaut had long made his home in Cincinnati, and that's where the ceremony will be held, the Associated Press reported.
Friday's service will be a private one, which isn't surprising given Armstrong's retiring nature. Though he shot to international fame after stepping onto the lunar surface on July 20, 1969, Armstrong never sought the spotlight.

U.S. Senator Rob Portman (R-OH) will eulogize Armstrong at the ceremony, according to the AP. Portman has described Armsrong ? who was born in the western Ohio town of Wapakoneta ? as "a good friend and adviser," the AP added.
To honor Armstrong, American flags at federal facilities will fly at half-mast on the day the astronaut is interred, President Barack Obama announced today (Aug. 27).
"As a mark of respect for the memory of Neil Armstrong, I hereby order, by the authority vested in me by the Constitution and the laws of the United States of America, that on the day of his interment, the flag of the United States shall be flown at half-staff at the White House and upon all public buildings and grounds, at all military posts and naval stations, and on all naval vessels of the Federal Government in the District of Columbia and throughout the United States and its Territories and possessions until sunset on such day," Obama said in a statement.
Discussions have also begun about a possible national memorial service for Armstrong, though nothing has been decided yet, the AP reported.
Armstrong commanded NASA's Apollo 11 mission, which lofted him, Buzz Aldrin and Michael Collins to the moon. Armstrong and Aldrin spent more than 21 hours on the lunar surface, while Collins orbited above in their command module Columbia.
After eight days in space, the mission returned safely to Earth on July 24, 1969, achieving the ambitious goal laid out by President John F. Kennedy in May 1961.
Apollo 11 was Armstrong's second, and last, spaceflight (he had previously blasted off aboard the Gemini 8 mission in 1966). The astronaut left NASA in 1971 to become a professor of aerospace engineering at the University of Cincinnati, a post he held for the next eight years. After that, he became active in several business ventures.
Armstrong cared deeply about the future of NASA and human spaceflight throughout his life, and in the last two years he waded into the public eye to let his voice be heard.
In 2010, he objected strongly to the Obama Administration's decision to cancel NASA's moon-oriented Constellation program. And in September of last year, he told the House science committee that he had misgivings about NASA's plan to rely on private companies to fly astronauts to and from low-Earth orbit.

There needs to be an effort to dispel some of the damaging myths out there surrounding bankruptcy that do nothing but help to keep people stuck in a disastrous financial situation. One big piece of misinformation is that people think they will lose their property if they file bankruptcy.
This is not true. For most people, they will not have to give up any property they wish to keep. Bankruptcy's primary goal is to give people a fresh start, free from the burdens of their massive debts. This goal would be impossible to pursue if it required that people who cannot afford to pay their debts were forced to hand over all their property to the bankruptcy court.
The Bankruptcy Code allows people to keep a certain amount of their property through the use of exemptions. How much you get to protect depends on which system you choose, state or federal. Each system is different and would be preferable depending on the circumstances of each case.
For instance, in the State of Washington, a person can choose the Washington Exemptions and protect more than $100,000 in equity in their home. The federal limit does not come close to approaching that level. For some reason, many people do not have this particular concern in the Washington and find the federal system perfectly good for their bankruptcy.
If your car is worth more than what you owe, the federal system allows you to protect a certain amount. The limit is $3,450 dollars in equity in your car.
Most people do not have a need for this particular exemption because the value of a financed car is usually way below what is owed on the car. If there is no equity, then no need to claim the exemption. You can keep the car if you like.
If a 2007 Ford Mustang has low miles and is in good condition, perhaps the blue book value would be around $9,000. If the client owes $12,000, the exemption is not needed. There is no equity in the car.
If you can afford to make the payments or work with your creditor, you will not lose your car in bankruptcy.
If the Mustang is only worth $9,000 and the debtor owes $6,000 then the exemption would be needed to protect the value. But understand that you do have room to protect your property.
The only debtors who really need to be concerned about this are people with substantial assets. These people need attorneys to help them plan how to best use their limited exemptions.
Most people, however, tend to fall well within the parameters of the exemptions allowed. This is true because almost everyone does everything in their power to liquidate their assets, pay off their creditors and avoid bankruptcy.
That is why it is important to know that you don't lose all your property in bankruptcy. You don't have to unemployed or homeless to file bankruptcy. Often times, whether to file bankruptcy is a mathematical decision and the goal of your attorney should be to make certain your interests are protected as fully as possible so that bankruptcy can be a springboard used to jump start a new financial beginning

South Sudan denies abuses cited by HRW in Jonglei report
JUBA (Reuters) - The head of a South Sudan disarmament campaign dismissed a Human Rights Watch (HRW) report saying soldiers had raped, beaten, tortured and killed civilians during the campaign in Jonglei, the country's largest state.
South Sudan seceded from Sudan a year ago under a 2005 peace deal and is awash with firearms after a decades-long civil war with Khartoum that killed an estimated two million people.
Run mostly by former guerilla fighters, South Sudan's nascent government has struggled to assert control over its vast and restive territories since declaring independence.
HRW, citing local officials, victims and witnesses, said soldiers in the national Sudan People's Liberation Army (SPLA), have committed the abuses since the disarmament campaign began in March, particularly in the eastern state's Pibor county.
The group urged the newly independent nation to investigate and punish those responsible.
Kuol Dim Kuol, head of the campaign in Jonglei, rejected the report and said the operation had succeeded in collecting thousands of guns.
"I believe those reports are not realistic," he told Reuters by phone from Jonglei.
The SPLA had mechanisms in place to hold unruly soldiers responsible, he said. "As I am talking to you now, I have about 30 SPLA who have been dismissed" because of abuses, he said.

The creative writing process is often a very weird one. If it were described in detail, without anyone knowing you were talking about the creative writing process, it would sound a lot like a conversation between a doctor and his patient? from an insane asylum.
So how exactly should?I make the process of developing a character not sound like I?m totally deranged??Maybe to say that the imaginary people and their imaginary voices in my head are of my complete creation and always within my control.
No? that actually isn?t exactly true. ?Okay? I still sound crazy. ?Let?s see?
Maybe to say that when I am done writing these imaginary people into characters, and write them down on paper, they then completely disappear from my mind and they no longer bug me by talking to me in the middle of the night?
Oh no? not true either. Now before you pull out the straight jacket? hold on, hold on! Just a minute!
I do decide if I want to listen to what these imaginary people say. I can disagree with them, and yes I can decide their fate even if they don?t like it. Ultimately, I do have complete power over them and they have no real power over me.
Okay. Men in the suits, you can leave now. I?m gonna be fine. Although my readership is still kinda freaked out.

Ok, probably one of the reasons writers don?t talk much about the creative process is because (like above) it makes us sound crazy. But really, the character-making process is not only the most fun part of writing?it?s also a chaotic, seemingly supernatural phenomena that is, at the same time, within our very real control. It?s as if we are masters of this crazy. I guess maybe we?re less like crazy people and more like that Whoopi Goldberg character in Ghost, or that kid in The Sixth Sense:
We see imaaaaaaginary peeeeople.
But instead of being haunted by these imaginary people, we writers welcome them in the den of our mind, have coffee or tea with them. We love to listen to what they, our characters, say to us.
Not all guests are welcome. Some of these would-be characters are definitely not welcome. Far too creepy, or too boring, or way too nice. I guess we?re very elitist and discriminatory in the characters we choose to speak to. They have to be heroic, they have to be unique, they must have a very interesting life. Or else: yawn! Bring in the next ghostly spirit!
Our favorite imaginary friendships are ones with imaginary people who have conflicted ideas about life, people who are at a crossroads, who are still getting to know themselves?and are not sure where to turn. These tend to be the most fruitful relationships. Because as authors we can help those friends, guide them, teach them lessons, throw rocks in their way to challenge them (and us), and help them finally reach their happy resolution. (Some authors will be vicious and lead their imaginary people to their doom, which I think is a bit cruel.)
Why Being A Little Crazy Is A Good Thing
Ok, so I?m trying to be funny with all this talk of ?crazy,? but, truly, the development of a character is a conversation. It?s akin to the relationship between a parent and a child. There are some instances when that child will not budge and will beg to go the way they want to go, and, in those instances, I will go with the child. But there are other times when the child is too naive to know what?s good for them. So, as their dutiful parent, I have to make the better decision, as much as the child protests.
Characters often start off as a smudge, then after some research into their lives you start to develop a sketch. That sketch gets colored in after a few rewrites and workshopping. It may take years before you can put out your 3D glasses on and see the character finally come to life.
I don?t think many non-writers know how much time is put into a character. Characters don?t just show up all fully formed and fleshed out. You have to raise a character, let it grow. It?s a combination of nature and nurture. You gotta have the right mix. It?s just like everything else in the creative writing process.
?Dude, but you implied that these characters aren?t always your creation and not always in your control.?Cra-zy!?
What I meant was that, creatively, it?s more interesting if I have a character who has a little free will. A character who can do things I have not planned. (Ah, how shall I describe this fellow writers? You?re all probably like: ??You dug your own hole, Ollin. Now get yourself out.? Uh. Thanks a lot.)

Characters are kind of like wind up toys. I make the toy and then I wind it up. The wind-up toy may go places I didn?t expect and crash into things. That doesn?t mean that I, the toy-maker, is crazy. It just means I made a toy that did what it was supposed to do. It was free to move and go places I didn?t expect?I made the toy capable of doing this so that I can observe and write everything I see it do, down. That?s what I meant when I said that characters are not completely in my control. In fact it?s best if they?re not. Otherwise, character-making would be pretty boring.

Coconut water is an excellent sports drink -- for light exercise
ScienceDaily (Aug. 20, 2012) ? Coconut water really does deserve its popular reputation as Mother Nature's own sports drink, a new scientific analysis of the much-hyped natural beverage concluded at the 244th National Meeting & Exposition of the American Chemical Society (ACS) in Philadelphia on August 20.
However, people who engage in strenuous exercise that involves a lot of sweat might want to take it all with a grain of salt ? literally ? or stick with a more traditional sports drink like Gatorade, said Chhandashri Bhattacharya, Ph.D.
"Coconut water is a natural drink that has everything your average sports drink has and more," said Bhattacharya. "It has five times more potassium than Gatorade or Powerade. Whenever you get cramps in your muscles, potassium will help you to get rid of the cramps. It's a healthy drink that replenishes the nutrients that your body has lost during a moderate workout."
Bhattacharya said that the potassium in coconut water also may benefit other people who do not exercise. The typical American diet is low in potassium and high in sodium, which is found in table salt. Other research has shown that such an imbalance is unhealthy. In one study, people who ate foods low in potassium and high in sodium had twice the risk of death from heart disease and a 50 percent higher risk of death from all causes. Other analyses indicate that a 12-ounce serving of coconut water has more potassium than a banana.
And it is high in healthful antioxidants, added Bhattacharya, who is with Indiana University Southeast in New Albany.
Coconut water is the clear liquid found most abundantly inside young, green coconuts, which are fruits of the coconut palm. It long has been a popular drink in the tropics, where street and beach vendors sell green coconuts with a drinking straw in the top. Coconut water now is available in bottles, cans and other containers, and marketers have promoted it as a healthy beverage.
Bhattacharya's team analyzed coconut water, Gatorade and Powerade and found that coconut water contained up to 1,500 mg/liter of potassium, compared to up to 300 mg/liter for Powerade and Gatorade. Coconut water, however, had 400 mg/liter of sodium compared to 600 for the other two drinks. It had comparable quantities of magnesium and carbohydrates as the other drinks. The price for all three beverages ranged from $2 to $3 for 8- to 12-oz containers, she said.
Coconut water's lower sodium content is where it fails as a good sports drink for people who engage in strenuous exercise that produces a lot of sweating, Bhattacharya said. Sweating makes people lose more sodium than potassium, and coconut water alone can't replace that lost sodium.
